First Offense DUI Penalties in Florida

Florida Statute 316.193 sets out the penalty range for a first DUI conviction. Fines run from $500 to $1,000, rising to $1,000 to $2,000 if your blood alcohol concentration (BAC) was 0.15 or higher. Jail exposure is up to six months, extended to nine months when BAC reaches 0.15 or higher or a minor was in the vehicle. The law also requires up to 12 months of probation and a minimum of 50 hours of community service.

Beyond jail and fines, a first conviction carries additional mandatory conditions:

  • License suspension: 6 to 12 months depending on whether you took or refused the breath or blood test
  • Vehicle impoundment: 10 days
  • Ignition interlock device: Required for at least 6 months if BAC was 0.15 or higher
  • DUI school and substance abuse evaluation: Standard conditions attached to any first DUI resolution
  • Insurance impact: FR-44 insurance, which carries higher liability minimums than standard SR-22, is required after a DUI conviction and typically causes significant premium increases

What to Do After a First DUI Arrest in St. Petersburg

Florida law gives you 10 days from the date of your DUI arrest to request a formal review hearing with the DHSMV’s Bureau of Administrative Reviews. Miss that window and you lose your right to challenge the administrative license suspension entirely. For eligible first-time offenders, requesting the hearing within that 10-day period may also allow you to obtain a Business Purposes Only (BPO) license to drive to work, school, or medical appointments during the suspension.

The administrative suspension process runs completely separately from the criminal DUI case, and both move on their own timelines. The civil side starts the moment you’re arrested. The criminal side begins when charges are filed. Waiting to see what happens can be one of the most costly decisions a first-time defendant can make.
