Fleeing and eluding is the statutory term for running away from the police in a motor vehicle. First offenses without aggravating circumstances, such as a serious accident or a dangerous high-speed chase, were until recently usually charged as misdemeanor criminal traffic offenses.

In recent years, however, the Florida legislature has increased the penalties associated with fleeing and eluding law charges, and the offense is now most often charged as a felony.
