Expunging and Sealing Records

Florida Expungement Lawyer

A debilitating aspect of having a criminal conviction on your record is its influence on your ability to find and retain work. Whether your record reflects a youthful mistake, a one time occurrence or a more extensive criminal history you are trying to keep in the past, having an attorney with experience handling expungements and record sealing is important.

At the Clearwater, Florida, office of Joseph Montrone, Jr., P.A., Attorney at Law, I bring experience and knowledge to my criminal defense practice. I understand the hurdles you face as you try to reestablish your life and career. For information on how to close the book on a criminal past and look forward to a prosperous future, contact me today and schedule a free initial consultation.

Sealing a Past Record

In general, the process of having a sealed record is initially conducted through the Florida Department of Law Enforcement (FDLE) with a background check. Once FDLE conducts the background check, a motion is filed with the court to seal your record. If you have no prior convictions, you may be able to have your record sealed. As a criminal defense attorney, I have the experience to help you file a motion with the court for such an action.

Once sealed, in most instances you can legally state that you do not have a criminal record. Subsequent background checks by prospective employers or schools will yield no criminal past as it is no longer public record.

Expungements and First-Time Offenders

  • Don't let a prior offense such as shoplifting or drug possession, perhaps mistakes of your youth, ruin your chances of obtaining a job. I have assisted clients with expungements, allowing them to move forward with their career or educational aspirations.
  • Upon request and review, the court may order the expunction of your record but it is not something that happens automatically. Having a criminal defense lawyer to help you with the process of expunging a record is the best way to protect your future.
